Indiana Supreme Court to Examine Questions Stemming from Car Crash

The Indiana Supreme Court will hear two certified questions from the 7th Circuit Court of Appeals related to a case stemming from a fatal car crash allegedly caused by two doctors who failed to warn the driver not to drive after taking prescription medications. The questions for the high court include whether the plaintiff can seek excess compensation from Indiana’s Patient’s Compensation Fund and whether Indiana’s Medical Malpractice Act applies to claims brought against doctors for individuals who did not receive medical care for the provider but were injured by the doctors’ negligent treatment of someone else, The Indiana Lawyer reports.
